Relative’s Visa
The immediate family member of a South African citizen or permanent resident, i.e. father, mother, brother, sister and child may apply for a relative’s visa, provided that the South African citizen or permanent resident has available an amount of at least R3000 per person per month as proof of his or her ability to financially care for the applicant. Proof of kinship must be proven in the form of an unabridged birth certificate. However, where an application is made by or on behalf of the child of a South African citizen or permanent resident.
Spousal Visa
This visa allows you to lawfully reside with your spouse who may be a citizen or a permanent resident.
Spouse of a foreigner holding a valid work visa may apply for a visitor’s visa 11.1.b.iv
As the spouse of a South African Citizen or Permanent Resident you are entitled to a visitor visa with work authorisation in terms of section 11(6) of the Immigration Act of 2002, as amended.
In the case of unmarried life partners, the couple would need to prove that they have been in a relationship for two years or more, this would include a signed notarial contract.
You may also qualify for Permanent Residence where the marriage has existed for at least 5 years.
For a recognised spousal relationship the holder of the visa is required to have a minimum of 5 years.
